These Terms of Service (“Terms”) govern your use of the Mosdoli Burger website, mobile application, WhatsApp ordering service, and any related services we offer (collectively, the “Services”). By using the Services you agree to these Terms.
1. Eligibility & Accounts
You must be at least 13 years old to use the Services. When you create an account or sign in via our login dialog, you agree to provide accurate information and to keep your credentials confidential. You are responsible for activity that occurs under your account.
2. Orders, Pricing & Payment
- All prices are shown in Gambian Dalasi (GMD) and include applicable taxes unless stated otherwise.
- We may refuse or cancel an order if items are unavailable, an order cannot be safely delivered, or we reasonably suspect fraud.
- Payment is processed by third-party providers. You authorise the charge for the order total, including any delivery fees, when you confirm the order.
3. Delivery & Pickup
Delivery times are estimates and may be affected by traffic, weather, or order volume. For pickup orders, please collect your order within the time provided to ensure quality and food safety.
4. Cancellations & Refunds
Because food is prepared fresh, orders generally cannot be cancelled once preparation has started. If your order is incorrect, missing items, or unsafe to consume, contact us as soon as possible and we will work with you on a fair resolution, which may include a replacement or refund.
5. WhatsApp & Messaging
When you contact us via WhatsApp, Messenger, Instagram, SMS, or email, you agree to receive transactional replies (such as order confirmations and delivery updates) through the same channel. You can opt out of marketing messages at any time by replying STOP on WhatsApp/SMS or by contacting us.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful, harmful, fraudulent, or abusive purpose.
- Attempt to access, scrape, reverse engineer, or disrupt the Services or any systems we use.
- Submit false orders, impersonate others, or use someone else's payment method without permission.
- Send threatening, harassing, discriminatory, or otherwise unacceptable content to our staff or through our messaging channels.
7. Intellectual Property
The Mosdoli name, logo, menu photography, and website content are owned by Mosdoli Burger or its licensors and protected by intellectual-property laws. You may not copy, reproduce, or use them without our prior written permission.
8. Disclaimers
The Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, or completely secure. If you have a food allergy or dietary restriction, please tell us before ordering.
9. Limitation of Liability
To the maximum extent permitted by law, Mosdoli will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
10. Changes to the Services or Terms
We may update the Services and these Terms from time to time. Material changes will be posted on this page with a new effective date. Continued use of the Services after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of The Gambia. Any disputes will be handled by the competent courts of The Gambia, unless mandatory consumer-protection law provides otherwise.
